If you find any inaccuracies on your background check, here's what you should do: start by requesting a copy of the report from the employer. Once you have it, carefully review it for errors, such as incorrect data, duplicates, mistaken identity, or outdated negative information. If you discover any issues, promptly provide the correct information to both the employer and the screening company. It's also crucial to ensure that even if there are no errors, your correct information is supplied to keep the report up to date and accurate.
What are my Background Check Disclosure and Consent Rights?
You have the right to be informed if an employer plans to use your background check information, and they can only do so with your written consent. The employer must also follow specific steps, including clear disclosure, obtaining your authorization, and providing you with advance notice and information about your rights under the FCRA if they take adverse action based on the background check report.
Can I Sue for Background Check Errors?
If you're passed over for a job due to errors in an employment background check or if the company fails to address your dispute, you have legal recourse under the Fair Credit Reporting Act. This act allows you to sue the company in federal court. If successful, you may receive statutory damages of up to $1,000, actual damages, punitive damages, as well as court costs and attorney fees. Background Check Error Checklist

WHAT YOU CAN DO

If there’s an error on the background check, request a copy, review it for mistakes, provide corrections if needed, and ensure your accurate information is included. If the employer did not follow FCRA procedures, check if they provided proper notice, obtained authorization, shared the report and summary of rights, and issued an adverse action notice with relevant information. Keep a record of all documentation regarding the issue and the steps the employer took.
